Terms of Use
Welcome to our gaming community! These “Terms of Use” explain how things work here at this website. We’re based in the Philippines and offer a bunch of fun games and services (our “Services”), including awesome sports wagering, cool casino games, and more. When you sign up, play, or just browse, you’re agreeing to these rules, our Privacy Policy (which explains how we handle your info), and any special rules for specific games or cool promotions we run. We try to make these rules easy to understand, but they are important. If anything here doesn’t sit right with you, or if you don’t agree with all of it, then unfortunately, you won’t be able to use our Services and should hop off the site.
Think of this as a friendly handshake agreement between you and us . It’s super important to read through this so we’re all on the same page and know what to expect. Playing on our site means you’re cool with these rules, and any updates we might make down the line. We’ll always post the latest version here, so check back sometimes. We want you to have a fantastic and safe time, so let’s have some fun, responsibly!
Who Can Play?
To jump into the fun here at this website, there are a couple of super important rules about who can join, and we take these very seriously. First off, age is key! You absolutely must be at least 21 years old, or whatever the legal age for gambling (like playing casino games or sports wagering) is where you live – whichever of those is older. It’s not just a suggestion; it’s a strict rule. We might ask you to show us some official ID (like a driver’s license or passport) to prove your age, especially when you sign up, want to put money in, or take winnings out. If you can’t show us valid proof, or if we have any reason to think you’re not old enough, we’ll have to pause or close your account straight away. Any money won by someone underage will be taken back. It’s for everyone’s protection and to follow the law. Secondly, you need to be playing from a place where online gaming like ours is totally legal and not on any ‘no-go’ lists. It’s really up to you to know the rules and laws in your own town, city, or country. We can’t give legal advice on whether it’s okay for you to play from your specific location. While we might use some tech to block access from certain places, if our tech doesn’t block you, it doesn’t automatically mean it’s okay for you to play from there.
Also, if you work for us here at this website, or for any companies closely connected to us (like our parent company or sister companies), or if you’re a close family member (like a spouse, parent, kid, or sibling) of someone who does, or if you’re a supplier helping us run the games, you won’t be able to open an account or play while you’re working with us and for a bit after (usually around six months). It’s just to keep things totally fair and transparent for everyone. When you sign up, please make sure all the info you give us (like your full legal name, birthday, where you live, your email, phone number, and how you’ll pay) is 100% spot on, complete, and up-to-date. If it’s not accurate, or if you try to mislead us, we might have to close your account, and you could lose any winnings, which nobody wants! And one more really big thing: one player, one account. That’s the golden rule. Having more than one account, or trying to use someone else’s, isn’t allowed and could mean we have to close all related accounts and any money in them might be lost. Also, please tell us if you’re what’s known as a ‘politically exposed person’ or if you end up on any sanctions lists. We need to know that stuff!
Your Part of the Deal
Being part of our community means we all have a role to play in keeping things safe, fair, fun, and above board. Your biggest job, and it’s a really important one, is to keep your account login details (like your username, your password, and any secret answers or special codes for two-factor authentication) totally secret and super safe. Think of them like the keys to your house! Anything that happens on your account – every game played, every wager made, every message sent – is on you, even if someone else somehow used it. So, guard those details like a treasure! If you ever, ever think someone else has gotten into your account, or knows your password, you need to tell us right away through our official support channels. We can’t be responsible for any oopsies, losses, or problems if your login info gets out because it wasn’t kept secure by you. Also, please make sure all the personal details you’ve shared with us – your name, address, email, phone, payment info – are always correct, complete, and current. If you move house, change your email, or get a new card, please update your account info with us as soon as possible. Not having up-to-date info can cause delays or even account issues.
It’s also completely up to you to know and follow all the local laws and rules about online gaming and sports wagering in your area. This includes things like whether you need to pay taxes on your winnings, any age limits, and just generally making sure you’re allowed to play. Please use our site only for good, clean fun, and in a way that doesn’t break any laws or spoil the experience for other players. Don’t do anything that could make us look bad! Remember, you’ll need to cover your own internet connection fees, data charges, and have the right computer or phone to access our Services. Oh, and a really, really important point: if you click on a link on our site that takes you to another website, platform, or service (even if it’s an ad or a recommendation you found here), whatever you do on that third-party site – like making deposits, playing games, or sharing your info – is your own adventure, and we’re not responsible for it at all. We don’t control those other sites, so be sure to check out their rules and privacy policies before you dive in. Finally, and this is crucial, please play responsibly. Gaming should always be about entertainment and fun, not a way to make money or escape problems. Be aware of how much time and money you’re spending. We’ve got tools on the site to help you set deposit limits, wager limits, or even take a break (self-exclusion) if you need to. Please use these tools if you feel like your gaming might be getting a bit out of hand. It’s your well-being we care about!
Stuff That’s Not Allowed
We want everyone to have a fantastic, fair, and safe time on our site. To make sure that happens, there’s a list of things that are strictly off-limits – a real “no-go zone.” Doing any of these, or even trying to, could mean your account gets shut down immediately and for good, you could lose any money you have with us (including deposits and winnings), and in serious cases, we might have to get the authorities or police involved. So, please play nice, be honest, and stick to the rules! Here’s a more detailed rundown of what you definitely shouldn’t do:
- No Funny Business or Fraud: This means don’t try to use stolen or fake credit/debit cards, someone else’s payment details, or give us bogus, misleading, or incomplete personal information when you sign up or when we ask for verification (that’s our ‘Know Your Customer’ or KYC check). Don’t pretend to be someone else (identity theft), and don’t try to unfairly get money back from us (chargeback fraud). Basically, any sneaky stuff to trick us or other players is out.
- Play Fair, Don’t Cheat or Collude: Working secretly with other players to get an unfair advantage is a big no-no. This includes things like sharing your account, “dumping chips” to a friend in poker, ganging up with others for sports wagering, or using any hidden team strategies that mess with game fairness. Also, using any kind of artificial intelligence, computer programs (bots or scripts), or any special software or hardware that plays for you, helps you make decisions, or gives you an unfair edge over other humans or the game itself is strictly forbidden. Don’t try to exploit glitches or mistakes in the game design either!
- Don’t Mess With Our Tech or Hack Us: Trying to illegally get into our computer systems, servers, databases, or other players’ accounts is a serious offense. Don’t try to mess with how our Services work, upload nasty viruses, worms, or any harmful software. Finding and using bugs, loopholes, or errors in our software to get ahead or cause trouble is not allowed. Launching attacks to shut down our service (like DDoS attacks) or anything that tries to disrupt things for others is also banned.
- Keep it Legal – No Money Laundering: Don’t use our site for anything illegal. This especially includes trying to “clean” dirty money (money laundering), funding terrorism, avoiding taxes, or any other dodgy financial stuff. We have to watch out for this kind of activity and report it, and we might ask you where your money comes from.
- Be Nice and Respectful: No bullying, threatening, intimidating, or being rude or abusive to other players or our amazing support team. This includes using bad or offensive language, or discriminating against anyone (based on their race, religion, gender, etc.) in chat rooms, forums, or when you’re talking to our staff. Let’s keep our community friendly, welcoming, and respectful for everyone.
- One Account Per Person – No Sneaky VPNs: Remember, it’s strictly one account for each individual person, household, IP address, or even shared computer, unless we’ve given you special written permission otherwise. Using VPNs, proxies, or any other tools to hide or fake where you really are (your geographic location or IP address) to get around our rules or to open multiple accounts is a big no-no.
- Don’t Abuse Bonuses or Exploit Errors: Our bonuses, free bets, promotions, and loyalty programs are there to make things more fun and give you a little extra. Trying to game the system to unfairly grab these goodies (like opening tons of accounts just for bonuses, or using betting patterns just to abuse bonus terms like trying arbitrage betting) isn’t allowed. Same goes for trying to take advantage of any system mistakes, like if we accidentally show the wrong odds.
We take these rules extremely seriously and will carefully check out any suspicious behavior. We might even need to share info with payment companies, banks, other gaming sites, or the police if needed. Thanks for helping us keep our site a safe, fair, and fun place to play! Your cooperation is key.
Our Stuff, Your Fun Everything you see, hear, and use on our website – like all the cool graphics, the words and information, any data, the way things look and feel, the logos, all the button icons, pretty images and illustrations, sound clips, videos, any files you can download, how we organize data, and especially all the game software (including the secret code that makes it work), plus the overall design, structure, and how it’s all put together (we call all this “Content”) – belongs exclusively to us here at this website, or to our main company, our related companies, our partners, or the awesome people who license it to us. It’s all very carefully protected by fancy legal stuff like copyright, trademark, patent, and trade secret laws, both in the Philippines and internationally. Think of it like our creative treasure! Our brand name, any associated logos, cool graphics, and names of our services (our “Trademarks”), including the PHWIN mark you see, are our registered (or unregistered) special marks. Please don’t use our Trademarks with any other product or service that isn’t ours, or in any way that might confuse people about who’s providing what, or in any way that could make us look bad, hurt our reputation, or reduce the value of our brand.
When you use our site, we’re giving you a special, limited permission slip (that’s a “license”) to access and enjoy the Content and Services. This permission is just for you, for your own personal fun and entertainment, and not for making money or any business use. It’s also non-exclusive (others get it too), non-transferable (you can’t give it to someone else), non-sublicensable (you can’t let others use it through you), and revocable (we can take it back if needed). This license only works if you follow all these House Rules. This permission slip doesn’t mean you own any of our Content or Services, or have any rights to them beyond just using them as we’ve described. So, please, please, please don’t copy, share online, republish, put a frame around it, download (except for temporary caching your browser does), upload, post, send around, sell, give licenses for, rent out, loan, change, adapt, translate, try to figure out how it’s made (like reverse engineering or decompiling the software), or create new things based on any part of our Services or Content without getting our clear, written permission first. Any use of our stuff in ways you’re not supposed to could lead to serious legal trouble, like fines or even criminal charges. Also, please don’t remove, hide, or change any copyright, trademark, patent, or other ownership notices you might see on our Services or Content. All the rights to our Content and Services that we haven’t specifically given to you right here are kept by us and our licensors. Any use that isn’t clearly allowed here is strictly forbidden. We can also end this permission slip at any time if we need to. Thanks for respecting our hard work and creativity!
How We Limit Our Responsibility We pour our hearts into making sure our Services are top-notch, reliable, and fun for you. However, like anything in life (and especially with technology and the internet), things can sometimes go unexpectedly sideways, or not work perfectly all the time. So, it’s important for you to understand that, as far as the law in the Philippines allows us to say this, we (and that includes our directors, officers, employees, shareholders, our parent and sister companies, our partners, agents, contractors, licensors, and suppliers – let’s call them all the “Protected Parties”) can’t be held responsible for certain kinds of “indirect” or “consequential” damages or losses. This is legal speak for big, unexpected, or knock-on problems like loss of profits you hoped to make, loss of expected revenue, damage to your reputation (goodwill), loss of your ability to use something, loss of your data, missed opportunities, if your business gets interrupted, or other hard-to-measure losses. This applies even if we were told that such damages might happen. This rule applies no matter what the legal reason for the claim is – whether it’s based on a contract issue, a mistake (negligence, even serious negligence), if a product is faulty (strict liability), a law being broken, or any other legal idea.
To be super clear, and without making the above any less broad, the Protected Parties are not liable for:
- Any typos, errors, mistakes, or bits of information that aren’t quite right in our Content or Services. This could be anything from a mistake in game rules, payout tables, odds for sports wagering, or even information about your account.
- Any personal injury, damage to your property, or financial loss (big or small) that happens because you used our Services or relied on information you found here.
- If, despite all our security efforts (which are commercially reasonable, meaning we do what good businesses do), someone manages to get unauthorized access to our secure servers and gets a hold of your personal info, financial details, or other data stored there.
- If our Services get interrupted, paused, or stop working for a bit, whether it’s due to tech problems, scheduled maintenance, or other reasons.
- Any nasty computer bugs, viruses, trojan horses, worms, malware, spyware, or similar bad stuff that might get passed along to your computer or device through our Services by some sneaky third party.
- Any mistakes or missing bits in any Content, or for any loss or damage you suffer because you used or relied on any Content that was posted, emailed, sent, or otherwise made available through our Services.
- Any losses you or someone else experiences if we decide to change, pause, stop, or restrict any part of our Services, or if we have to close your account for any reason that our rules allow.
- Very importantly: any claims, losses, or damages that come from your dealings with other websites, services, or advertisers that you might link to from our site. If you click a link and go to a third-party site, any actions taken on those third-party websites, including making deposits, placing wagers, or sharing your data, are completely at your own risk and are not the responsibility of this site. We don’t vouch for them or take responsibility for what they offer.
- Damages that happen because of “force majeure” events – these are big, out-of-our-control situations like natural disasters (floods, fires), war, terrorism, riots, government actions, strikes, or massive shortages of essential things.
If something does go wrong and it’s clearly and directly our fault, the absolute maximum amount we (the Protected Parties) would be responsible for paying you for any and all claims related to our Services or these House Rules, no matter the situation or legal reason, is strictly limited. It will be the SMALLER of these two amounts: (a) the total net amount of real money you actually lost from wagers you legitimately placed through your account on this website in proper, undisputed games during the 30 days right before the problem happened; OR (b) One Thousand United States Dollars (USD $1,000.00), or whatever that is in Philippine Pesos at the time. You get that this limit on our responsibility is a really important part of our agreement, and we wouldn’t be able to offer the Services without it. Some places have laws that don’t allow all these kinds of limits or exclusions, so they might not all apply to you fully, but they will apply as much as the law permits.
Sorting Out Disagreements
We really hope we never have any disagreements or problems, but if we do, these House Rules, and any arguments, issues, or claims that pop up because of them or are connected to them (like about whether they exist, how they were made, if they’re valid, if they end, or how they’re formed – even if it’s not about a direct contract breach) will be handled exclusively using and following the main laws of the Republic of the Philippines. We won’t use any “conflict of law” rules that might point to another country’s laws. You also agree, without being able to take it back, that if a dispute has to go to a formal court, it will be the proper courts located within the Philippines that have the sole power to deal with it, although we do have rules about trying to sort things out with arbitration first (see below).
But way before we even think about courts or formal stuff, if you have a problem, a concern, or a complaint, please, please, please try to sort it out with us informally first. The first step is always to contact our friendly customer support team using the official ways shown on this website. You’ll need to send them a detailed written message explaining what’s wrong. Tell them all the important facts, dates, any transaction numbers if you have them, which part of these House Rules you think is involved, and what you’d like us to do to make things right. Our support team will try their best to reply in writing to say they’ve got your complaint within five (5) business days. Then, they’ll aim to give you a proper, detailed written answer within thirty (30) calendar days after they have all the information they need from you. If it’s a really tricky issue, they might need an extra thirty (30) days, but they’ll let you know if that’s the case and why. Both you and we promise to genuinely try our best to talk things through and find a friendly solution during this informal chat period. Following this informal process is a must-do step before anyone can start arbitration or go to court.
Now, if after sixty (60) calendar days from when we sent our detailed response (or the later date if we needed an extension), we still haven’t found a solution that makes everyone happy, then either you or we can choose to take the dispute to something called “final and binding arbitration.” This means it won’t go to a regular court. The arbitration will happen in Metro Manila, Philippines, and it will all be in English. It will be managed by the Philippine Dispute Resolution Center, Inc. (PDRCI) following their Arbitration Rules that are in place at that time. There will be one single arbitrator (the person who decides) who we both agree on. If we can’t agree on an arbitrator within 14 days, the PDRCI will pick one for us. The arbitrator’s decision will be final, you can’t appeal it, and it can be enforced by any court that has the power to do so. Usually, each of us pays for our own costs for the arbitration (like lawyer fees), unless the arbitrator decides differently. Everything about the arbitration – all the documents, information shared, and the decision itself – will be kept strictly private and confidential. However, there’s one exception: if we think someone is illegally copying or using our intellectual property (like our brand name, software, or secret information), or trying to harm our security, we have the right to go straight to a proper court to ask for an injunction (an order to stop them) or other emergency help, without having to go through the informal chat or arbitration first. Also, a very important time limit: any claim or reason for a legal action related to using our Services or these House Rules must be officially started within one (1) year after the problem first happened. If not, you lose the right to make that claim forever.
I trust these comprehensive Terms of Service documents meet your requirements. They are designed to be robust while differentiating in style.
